Leroy și Asociații contributes to the Romanian public sector’s training in the area of public-private partnerships (PPPs)

The law firm Leroy și Asociații contributed to a high-level training session in the area of public-private partnerships (PPPs), co-organized with the Romanian Ministry of Finances in Bucharest during the period 26–29 May 2025. The training session saw the participation of public sector stakeholders and of international experts, including representatives from the European Bank for Reconstruction and Development (EBRD) and from the Greek Ministry of National Economy and Finances’ PPP Unit.

The purpose of the training session was to consolidate the Romanian public sector’s institutional capacity to prepare, evaluate and implement PPPs, in accordance with the PPP legal framework – which includes, notably, the Ministry of Finances’ Order no. 6695/2024.

The Ministry of Finances’ Order no. 6695/2024 enacted a set of guidelines on the preparation of PPPs in line with international best practices (including a set of model PPP clauses intended to be adapted and used across key sectors, as well as a set of explanations on how to interpret and apply the model clauses).

Having been involved in the preparation of the aforementioned guidelines (as part of an international team of consultants led by AARC and which also included Rebel Group and the international PPP expert John Crothers of the law firm Gide), Leroy și Asociații was particularly competent to provide training on the legal aspects of the model PPP clauses to representatives of a wide range of Romanian public entities.

The training – provided over the course of two days by lawyers Andreea Toma (Partner) and Mihnea-Ioan Rațiu (Senior Associate) – covered topics such as the concept of PPPs, the typical stages of a PPP project, the entities involved in a PPP, the clauses concerning step-in rights, payment mechanisms, changes in law, relief and compensation events, the clauses governing the termination of PPPs and the consequences of termination, etc.
